Provision

 

The law governing TCR in Malaysia is the Merchant Shipping Ordinance 1952 for registration of ship less than 150 GT and comply to :

 

1.    The provisions of Part IIA of the Ordinance, except :

 

a.    subsection 16(2), and sections 20, 22, 26, 26A, 30, 31 and 32; and

b.    in respect of sections 36, 37, 39, 39, 41, 42, 27, 28, 29 and 56.  

 

  1. Merchant Shipping (Terminable Certificate of Registry) Regulations 2005.

 

Every boat plies at any port, river or place in Malaysia for any of the following purposes need to be licensed

a.    Trade or business

b.    The transportation of any person other than for trade or business; or

c.    sports, leisure or recreational activity

 

SHIP QUALIFICATION

 

Cargo or passenger ship less than 150 GT and length not more than 24 metres.

 

OWNERSHIP Qualification

 

 A person or a body corporate shall not be deemed to be an owner of a licensed boat unless it is wholly owned by persons of the following description :

1.    Malaysian citizen

2.    Permanent residence of Malaysia; or

3.    Corporation which are incorporated in Malaysia and wholly owned by Malaysian citizens.

 

VALIDITY OF REGISTRY

 

The Registrar may grant the registration of ship for a period not exceeding than five (5) years.
